General Terms and Conditions

§ 1 Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Glander Farben und WohnStore e.K. (hereinafter "Seller") and the customer via the online shop at www.holzboden-direkt.de as well as through our showrooms, by telephone or email.

The GTC apply to consumers (§ 13 BGB) and businesses (§ 14 BGB). Deviating conditions of the customer are not recognised.

§ 3 Contract Formation

The presentation of products in the online shop does not constitute a legally binding offer. By placing an order the customer submits a binding offer. The seller may accept this offer within 5 working days by order confirmation via email.

§ 4 Contract Language

The contract language is German. The contract text is stored after conclusion and made available to the customer upon request.

§ 5 Product Descriptions

Product descriptions reflect the status at the time of creation. Industry-standard deviations in dimensions, weight and colour representations do not constitute a defect.

§ 6 Natural Product Wood

Wood is a natural product. Differences in colour, grain and knot content are natural characteristics and do not constitute a defect. This also applies to seasonal variations.

§ 7 Samples and Showroom Areas

Samples and display products are for illustration purposes. They do not create an entitlement to identical delivery as the product may come from different production batches.

§ 8 Production Batches

For subsequent orders, colour identity with already delivered goods cannot be guaranteed. This applies in particular to smoked and colour-treated products.

§ 9 Waste Allowance

When calculating the order quantity, a waste allowance must be factored in:

  • Parquet: 5–10 %
  • Laminate / Design floor: 5–8 %
  • Complex layouts (diagonal, irregular floor plans): up to 15 %

§ 10 Delivery Terms

Deliveries are made exclusively within Germany by freight forwarder to the kerbside. Unloading is the responsibility of the recipient. Access must be available for vehicles up to 40 t and a minimum width of 3.5 m.

§ 11 Default of Acceptance

In the event of default of acceptance by the customer, the seller may store the goods at the customer's expense and risk. After a reasonable grace period, withdrawal from the contract is possible.

§ 12 Obvious Input, Calculation and System Errors

In the case of obvious input, calculation, transmission or technical system errors, in particular incorrect units of measurement (e.g. m² instead of linear metres), price calculations or other errors recognisable to a reasonable customer, we are entitled to correct the order or – where legally permissible – to withdraw from the contract. Any payments already made will be refunded without undue delay in such a case. Statutory rights, in particular due to an error under the applicable statutory provisions, remain unaffected.

§ 13 Prices and Payment Terms

All prices are total prices in euros including statutory VAT. In the event of default, reminder fees of € 1.50 per reminder are charged to consumers.

§ 14 Retention of Title

The delivered goods remain the property of the seller until all claims arising from the contract have been paid in full.

§ 15 Transport Damage

Visible transport damage must be reported immediately to the carrier and noted on the delivery note. Hidden damage must be reported in writing within 3 working days at the latest.

§ 16 Installation and Craft Services

Installation and craft services are concluded as a separate work contract. Existing floor coverings remain the property of the client.

§ 17 Subfloor Inspection

The subfloor must be checked prior to laying. DIN 18365 (floor covering work) and DIN 18356 (parquet work) apply. Non-destructive testing is part of the service.

§ 18 Room Climate

Wooden floors require a constant room climate of 18–22 °C and a relative humidity of 40–60 %. Deviations do not give rise to warranty claims.

§ 19 Storage of Parquet

Wooden floors must be stored dry in a professional manner prior to laying and acclimatised lying flat in the installation area for at least 48 hours.

§ 20 Customer-Supplied Materials

The seller does not accept liability for materials supplied by the customer.

§ 21 Warranty

Warranty period: 2 years for consumers, 1 year for businesses from date of delivery. For merchants, § 377 HGB applies (immediate duty to inspect and give notice of defects).

§ 22 Liability

Unlimited liability for injury to life, body and health, for intent and gross negligence. For simple negligence and breach of cardinal obligations, liability is limited to the foreseeable, contractually typical damage.

§ 23 Usage Rights

All planning documents, sketches and drawings are protected by copyright and may not be passed on without permission.

§ 24 Care and Usage

Proper care in accordance with care instructions is mandatory:

  • Fit furniture with suitable glides
  • First 2 years: no rugs with plasticisers (WzW)
  • Clean floor only with a damp mop
  • Room climate 18–22 °C / 40–60 % rel. humidity

§ 25 Code of Conduct

The seller has committed to the code of conduct of Trusted Shops: www.trustedshops.de

§ 26 Dispute Resolution

The EU Commission's OS platform was discontinued on 20.07.2025. The seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 27 Place of Jurisdiction

Place of performance and jurisdiction for merchants is Lüneburg.

§ 28 Final Provisions

German law applies. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. Should individual provisions be invalid, the validity of the remaining provisions shall not be affected.
